GENERAL TERMS OF SALE IN FORCE ON SEPTEMBER 5th, 2010

DEFINITIONS

In the present General Terms of Sale, the terms listed below will have the following significance:

• Videos: the Service’s audiovisual product.
• Service: the on-demand video service which allows the User to view streamed Videos, for strictly private and personal use. This on-demand video Service is available only to individuals.
• User: any natural person having fulfilled the terms of access to the Service in order to gain access to the Service’s Videos.

The EQUIDIA VIDEO website, hereafter the “Site”, allows web Users to view Videos of horse races, according to the following methods:

• Viewing of the latest Quinté+ race and of the main grand prix races of the last 3 years is free on the Site.
• Viewing of all other Videos of races is dependent on subscription to one of the pre-paid plans listed below.

OPENING AN ACCOUNT

To open an account, all that is needed is to fill in the form on the Site. Opening an account is free apart from connection costs.

CLOSING ACCOUNT

To close an account, send your request by mail in Contact or Customer Service in My Account.

TARIFFS

To view paid videos, web Users can choose between the following pre-paid plans:

• N°1 plan: 2 € for 10 Videos
• N°2 plan: 10 € for 65 Videos
• N°3 plan: 20 € for 135 Videos

These prepaid plans are valid for two (2) years from the date of purchase.
If an account holder fails to redeem his/her entire Video credit within the period of validity of his/her pre-paid plan, no refund will be payable. This will also be the case upon closure of the account by the account holder.

• N°4 plan: 30€ with unlimited access to Videos.

This pre-paid plan is valid for 90 days from the date of purchase.
Please note that the pre-paid plans can be modified and/or removed at any moment. In the event of a pre-paid plan being suddenly removed and/or modified, the account holders having subscribed to the pre-paid plan in question before the date of modification and/or removal will be able to use that plan until their “Video” credit is used up, and/or until the expiry date of their plan.

CONDITIONS OF PAYMENT

The price to be paid is payable immediately upon placing an order.
The User recognizes that the communication of credit/debit card information is interpreted as authorization for PMU to charge the holder’s bank account.
The User can view all past transactions in the “My account” section.

DISTANCE SALES

Use of the Site implies an active step on the part of the Web User and in all points in accordance with the necessary requirements as regards distance sales, and for this reason in particular with articles L111-1, L113-3 and L121-18, and following articles, of French Consumer Law (Code de la Consommation) and with articles 1369-1 and 1369-2 of French Civil Law (Code Civil).
Due to the nature of the provision of immaterial services, which provision commenced with the agreement of the User before the end of the withdrawal period, and pursuant to article L121-20-2 of the Code de la Consommation, the User cannot exercise his/her right of withdrawal.

USE OF THE SERVICE

PMU/EQUIDIA can in no case be held responsible in the event of disappearance, loss, deterioration and in particular of any damage likely to alter the material necessary for the use of the Service.
Access to the Service is ensured permanently, subject to maintenance periods, server update operations and possible exceptional service interruptions.

PROPERT RIGHTS

This website, as well as its contents, race Videos and organisation, are protected by French law, and specifically those provisions relating to legal protection of databases, to literary and artistic property law, to trademarks and related rights. All rights of reproduction and representation reserved. The holder of the rights to the Site expressly indicates his/her intention to prohibit the use of all or part of the protected elements. The web User commits himself/herself to respect these provisions and in particular to make only private use of Videos to which he/she has access or data obtained on the Site, and no other use.

In all cases, the web User agrees:

• Not to use Videos to which he/she has access, or data obtained, on behalf of or for the profit of a third party.
• Not to reproduce in number, whether for profit or not, Videos or data obtained.
• Not to save or copy Videos, or any of the data available on the Site, in any format which could be used to reconstruct all or part of the original Videos and/or data.

Any person violating the above rights is liable to be prosecuted.
These General Terms are subject to French law.

APPLICATION

Ordering Videos available on the Service is open only to those Users who have read and accepted the General Terms of Sale, fully and unconditionally, prior to placing any order.
Any order implies full and whole acceptance of these Terms. These General Terms of Sale can be saved and printed by any person visiting the Site.
